Hi, I’m Kaye DeSelms Dent with Dent Coulson Elder Law, Here with an Elder Law Minute for you. Today we’re going to talk about what can be done if a long-term care policy isn’t paying out to the facility.
We do have clients who run into trouble from time to time, I think in most cases, it’s not a problem but it does happen, and usually it’s a matter of communication. Wes and I do assist clients in dealing with the communications between the insurer and the facility, sometimes it’s a little more than that and there may be other issues that arise, but we are certainly here to help. One thing to not is that it’s very important as you age to make certain that you have a really good plan in place to have people who can stand in your shoes, if you’re disabled to the point that you can’t take care of your own business, even if its for a matter of convenience. Maybe you’re perfectly competent, you have all of your faculties about you but you’re very physically disabled and you need nursing home care, it may be very difficult or inconvenient for you to be the person who’s communicating with the insurer and the facility and you may not have access to email, fax and all the things that you may need, so you need to have powers of attorney in place. A power of attorney for property and for health care so you have people appointed to help you take care of these issues and to also go to an attorney like Wes or myself for assistance when it’s needed.

We help families on a regular basis, deal with these issues. Again a lot of times, it’s a matter of the very pretty intense paperwork that’s required to establish eligibility for benefits and ongoing eligibility for certain records and notes and documents to be given from the facility to the insurer to support the claim each month, because nursing homes are paid by the month. So we have clients who might sail along just fine and then all of a sudden have an issue and it’s because something didn’t get transmitted. We’ve even had it be as simple as a fax interruption. You just never know what’s going to happen, but again we are here to help you if you have any difficulties with the long-term care insurance paying out. But a reminder, these are usually it’s very good insurance to have and we do recommend it, but everybody has some snafu’s and we’ve noticed that things have issues of increase due to Covid because everybody’s got staffing issues and people working from home. So be patient, but reach out when you need help.
