The Medicaid Long-Term Care Eligibility Appeal Process
Today I’m going to talk about the Medicaid long-term care eligibility appeal process.
When You May Need to File an Appeal
So, if you receive what’s called a notice of decision, uh, which is the official decision on your application, and you are unhappy with that decision, if it imposes a spendown that you disagree with or a penalty period that you disagree with, or there’s another issue that you think needs to be addressed, you do have the ability to file an appeal, uh, those appeals must be filed within 60 days of the notice of decision in order to be considered timely.
Appeals and Medicaid Planning
Even in cases where you haven’t done uh pre-planning ahead of your application, filing an appeal can help you reach a favorable outcome and to decide if any planning needs to be done at this point.
