Introduction
Hi, I’m Crystal Post. I’m the new junior associate at Dent Coulson Elder Law. I’m really hoping that these Elder Law minutes provide some insight and understanding to complex issues that everyday people face in the estate planning journey.
Guardian Ad Litem in Guardianship Cases
I’m going to briefly discuss the guardian ad Litem process when petitioning for guardianship.
So the guardian ad Litem often referred to as just the GAL is an attorney appointed by the court to act as an independent advocate for the best interests of the respondent who is the alleged ward or person with a disability.
Illinois Legal Requirement
The appointment of the GAL is a statutory requirement under Illinois law and so the court must appoint one unless the court finds it unnecessary.
The Guardian Ad Litem Process
So the GAL reviews the guardianship petition, meets with the respondent, and then conducts their own report to be filed in court.
Then the GAL will likely appear to testify at the court hearing to testify whether they think guardianship is appropriate.
