Will Medicare pay for a Rehab stay in a Nursing Home?

Hello, I’m Wes Coulson and this is your Elder Law Minute. I want to talk about one particular subject relating to the circumstances in which Medicare may pay for a rehab stay in a Nursing Home. One of the requirements for Medicare to pay is that somebody has to have had at least a three-day hospital stay. Now, one of the trends that have been occurring in recent years is that hospitals have been admitting people, but instead of calling them an “in-patient” they’ve said that they have admitted them “under observation.” If someone is in the hospital “under observation,” the time that they spend does not meet the three-day requirement. So, if you’re looking at Medicare to pay for a rehab stay, you need to find out whether you’re an “in-patient” or “under observation.” Thanks.
